Why this policy matters to a nature-art store</h2>\n<p>Native Heart Tee creates and sells apparel and gifts carrying artwork inspired by North American landscapes and wildlife, and by visual motifs associated with Native cultures such as feathers, geometric borders and night-sky symbols. Working in this space carries a particular responsibility. Beyond ordinary copyright and trademark law, there are laws and long-standing concerns about how Native American identity and cultural heritage are used in commerce. This page explains what we own, what we will not do, and how anyone can raise a concern.</p>\n<h2>2. What we own</h2>\n<ul>\n<li><strong>Brand:</strong> the name Native Heart Tee, the heart-and-horizon logo, and the look of our website.</li>\n<li><strong>Artwork:</strong> designs created for us or licensed to us for use on our products.</li>\n<li><strong>Content:</strong> product descriptions, guides, policies and other text on nativehearttee.com, and product images created for the store.</li>\n</ul>\n<p>You may share links to our pages and post photos of products you have bought; we enjoy seeing them. You may not copy our designs onto other products, sell items with our artwork that did not come from us, use our logo in a way that suggests we endorse you, or copy our text onto other websites.</p>\n<h2>3. What buying a product includes</h2>\n<p>When you buy a hoodie or a blanket from us, you own that physical item and may use, give away or resell it. The purchase does not transfer copyright in the design or give a licence to reproduce it. Printing our design onto other items, scanning it for digital use or using it in advertising requires our written permission. For licensing questions, email us with a description of the proposed use.</p>\n<h2>4. Our commitments on cultural and tribal identity</h2>\n<p>We hold ourselves to the following rules, which also help us comply with the United States Indian Arts and Crafts Act and similar consumer protection laws:</p>\n<ol>\n<li>We do not describe our products as &#8220;Native American made&#8221;, &#8220;Indian made&#8221;, &#8220;authentic Native&#8221; or as the work of any tribe or tribal member.</li>\n<li>We do not use the names, seals, flags, logos or other marks of any tribal nation or Native organisation.</li>\n<li>We do not print images of real, identifiable people, including historical figures, without the rights to do so.</li>\n<li>We avoid sacred items and regalia, such as war bonnets, in our designs and image briefs.</li>\n<li>We describe our work honestly: Native-inspired nature art, printed to order in the United States.</li>\n</ol>\n<p>If you believe a design, product name or description falls short of these commitments, please tell us. We read these messages carefully, and we would rather remove a design than cause harm. Where we agree, we unpublish the item, stop production, and tell you what we changed.</p>\n<h2>5. Respecting other people&#8217;s rights</h2>\n<p>We do not knowingly sell products that infringe someone else&#8217;s copyright, trademark, design rights or right of publicity. That includes sports team logos, brand names, film and TV characters, song lyrics, and images of celebrities. Designs are checked before they are published, but no process is perfect, which is why the reporting routes in the next sections exist.</p>\n<h2>6. Reporting a trademark or other IP concern</h2>\n<p>For trademarks, publicity rights, cultural concerns and anything other than copyright, email <a href=\"mailto:support@nativehearttee.com\">support@nativehearttee.com</a> with the subject &#8220;IP Concern&#8221; and include:</p>\n<ul>\n<li>your name, organisation (if any) and contact details;</li>\n<li>the right you are concerned about, such as a registered trademark (with registration number and country if you have it), a name or likeness, or a cultural concern;</li>\n<li>the exact URL or URLs on our site;</li>\n<li>a short explanation of why you believe the material is a problem;</li>\n<li>a statement that the information is accurate and that you are the rights owner, are authorised to act for them, or are raising a cultural concern in good faith.</li>\n</ul>\n<p>For copyright in artwork, photographs or text, please follow the more formal steps on our <a href=\"/dmca/\">DMCA</a> page so that both sides have the protections the law provides.</p>\n<h2>7. What we do with a report</h2>\n<table class=\"policy-table\">\n<caption>How we handle intellectual property reports</caption>\n<thead>\n<tr>\n<th scope=\"col\">Stage</th>\n<th scope=\"col\">Action</th>\n<th scope=\"col\">Timing</th>\n</tr>\n</thead>\n<tbody>\n<tr>\n<td>Acknowledge</td>\n<td>Confirm receipt and ask for anything missing</td>\n<td>Within 1 business day</td>\n</tr>\n<tr>\n<td>Assess</td>\n<td>Compare the material with the right described</td>\n<td>Usually within 3 business days</td>\n</tr>\n<tr>\n<td>Act</td>\n<td>Unpublish, edit the description, or rename the product; stop printing for new orders</td>\n<td>Promptly once we agree there is a problem</td>\n</tr>\n<tr>\n<td>Explain</td>\n<td>Tell you what we did, or why we disagree and what information would change our view</td>\n<td>With the outcome</td>\n</tr>\n</tbody>\n</table>\n<p>If we remove a product, customers with unprinted orders for it are refunded in full.</p>\n<h2>8. Designs from outside artists</h2>\n<p>If we work with independent artists, each one confirms that their designs are original and do not copy others or use protected marks. Artists whose work is repeatedly the subject of valid complaints will no longer supply designs to us. Artists are credited where they wish to be, and their rights are respected under the terms of their agreements with us.</p>\n<h2>9. Customer-supplied text</h2>\n<p>When a product allows personalisation, customers agree not to submit text that infringes trademarks or copyrights, such as brand slogans, team names or lyrics. We may refuse to print such text and refund the item. See our <a href=\"/terms-of-service/\">Terms of Service</a> for the full rules on personalised content.</p>\n<h2>10. Use of our brand by others</h2>\n<p>Please do not register domain names, social media accounts or marketplace stores using &#8220;Native Heart Tee&#8221; or confusingly similar names, and do not use our logo or product photos to sell items that do not come from us. If you see this happening, a link sent to <a href=\"mailto:support@nativehearttee.com\">support@nativehearttee.com</a> helps us protect customers from counterfeit goods. We do not currently operate any social media accounts or marketplace stores; anything claiming to be ours elsewhere is not.</p>\n<h2>11. Fair use, commentary and reviews</h2>\n<p>We do not object to honest reviews, commentary, news reporting or criticism that refer to our products or show photos of them. Linking to our pages is always welcome.</p>\n<h2>12. Disputes</h2>\n<p>If you disagree with our decision on a report, reply with any additional information and we will review it again. Formal legal disputes are governed by our <a href=\"/terms-of-service/\">Terms of Service</a>. Nothing in this policy limits anyone&#8217;s legal rights.</p>\n<h2>13. Information included in reports</h2>\n<p>We use the personal information in an IP report only to handle that report. We may share it with the person responsible for the material, if that is not us, so they can respond. Our <a href=\"/privacy-policy/\">Privacy Policy</a> explains how long we keep records and how you can ask about them.</p>\n<h2>14. Questions people ask</h2>\n<h3>Can I use a photo of my Native Heart Tee hoodie on my own social media?</h3>\n<p>Yes. Photos of products you own, shared personally, are welcome. Please do not use our product photos or artwork files to advertise something else.</p>\n<h3>Can I buy a licence to print one of your designs on my own products?</h3>\n<p>Possibly. Email us with the design, the product, the quantity and where it will be sold. We will tell you whether we can license it; nothing is permitted until we agree in writing.</p>\n<h3>Are your designs made by Native American artists?</h3>\n<p>We do not make that claim for any of our products. Our designs are nature art inspired by the land and its wildlife. If we ever collaborate with a Native artist, the product page will say so clearly, with their permission, and in a way that complies with the law.</p>\n<h3>I found a shop selling your designs. Is it you?</h3>\n<p>Native Heart Tee sells only on nativehearttee.com. If you find our artwork, logo or product photos on another site or marketplace, it is not us. Please send us the link before buying; counterfeit sellers often use stolen photos and deliver something quite different, and we cannot help with orders placed elsewhere.</p>\n<h3>Can I suggest a design idea?</h3>\n<p>You are welcome to. Please understand that we may already be working on similar ideas, since wolves, eagles and mountains are common subjects in nature art, and that suggesting an idea does not create any ownership or payment arrangement. If you are an artist with finished work to license, say so and we will reply separately.</p>\n<h3>How do you choose which motifs to use?</h3>\n<p>We start from the land itself: animals, plants, weather, landscapes and the sky. Geometric borders and feather shapes are drawn in our own style rather than copied from specific traditional works. We stay away from sacred items, ceremonial regalia, and the names or symbols of specific nations. When we are unsure whether a motif is appropriate, we leave it out.</p>\n<h2>15. Reviewing our catalogue</h2>\n<p>As our catalogue grows, we review older designs and descriptions against this policy at least once a year. Products that no longer meet our standards are retired, even if they sold well. If a customer has an unprinted order for a retired design, we contact them and offer a refund or an alternative.</p>\n<h2>16. Summary of what is and is not allowed</h2>\n<table class=\"policy-table\">\n<caption>Common uses of Native Heart Tee material</caption>\n<thead>\n<tr>\n<th scope=\"col\">Use</th>\n<th scope=\"col\">Allowed?</th>\n</tr>\n</thead>\n<tbody>\n<tr>\n<td>Wearing, gifting or reselling an item you bought from us</td>\n<td>Yes</td>\n</tr>\n<tr>\n<td>Posting your own photos of our products online</td>\n<td>Yes</td>\n</tr>\n<tr>\n<td>Linking to our pages or quoting a short passage in a review</td>\n<td>Yes</td>\n</tr>\n<tr>\n<td>Printing our artwork on other products</td>\n<td>No, unless licensed in writing</td>\n</tr>\n<tr>\n<td>Using our product photos or logo to sell other goods</td>\n<td>No</td>\n</tr>\n<tr>\n<td>Copying our policy or guide text to another website</td>\n<td>No</td>\n</tr>\n</tbody>\n</table>\n<p>If a use you have in mind is not on this list, ask us first. A short email describing the idea is usually all it takes to get a clear yes or no.</p>\n<h2>17. Contact</h2>\n<p>Nativehearttee, 160 Azure St., Morro Bay, CA 93442, United States.
